The Supreme Court has abruptly decided, without explanation, to cancel oral arguments about Title 42, planned to happen on March 1st.
The Supreme Court likely made this decision as a result of the Biden administration’s announcement to end the COVID public health emergency on May 11; Title 42 loses its legal justification once the emergency ends. In the meantime, the administration continues to enforce Title 42 along the border. In the last month alone, more than 40% of those arriving at the border were expelled under the policy, the highest percentage since last summer.
In the coming months, people will continue to struggle to find access to shelter, food, and medical care as Title 42 forces them to remain in Mexico. We are quickly approaching the third anniversary of Title 42, three long years in which the US asylum system has been brought to a grinding halt. Little can be done to heal the harm this policy has brought upon countless mothers, fathers and children. We can though create a future where such inhumane policies are never used again to deny people their rights and dignity.
